Before Santiago, July 12.—(Special.)—
General Toral has refused to accede
to General Shafters second demand
for an unconditional surrender, and
says he is determined to resist.
Washington, July 12.—(Special)—
The expectation was general ^oday
that Santiago would be oun very soon.
The m^in source of apprehension was
that the Spaniards may have succeeded
in a considerable degree, in evacuating
the town before the American lines
were completed,, so that when the
•American troops enter, there would
. only be found a mere empty husk with
nothing more than a desperate rear
, gaurd of Spaniards left to protect and
' conceal the retreat of the main body
of troops. .
There were indications of some such
move, which is supposed to have been
in' progress for the last three or four
days.. General Shafter himself reported
under date of Sunday that the Span­
iards had evacuated a small town on
the west side of the bay, one of the
suburbs of Santiago, while the Associ­
ated Press dispatches yesterday refer­
red to the departure of a body of Span­
ish troops from Santiago toward
•Holguin.
Of course these facts are not con­
clusive that the town .has been evac- uated by the Spanish army, but the
fact cannot be concealed that there is
apprehension prciaiUBg.
General Miles, who arrived yester­
day at Siboney on the Yale, made the
following report to Secretary Alger
today. "Arrived at noon and had a
coBsultation with Admiral Sampson
and with General Shafter by telephone.
Troops brought from Tampa, Charles­
ton and New York have arrived and
are leaving for the front. The line of
^ investment is being extended.

General Miles has not taken and .will
not take charge of the operations now
being conducted against Santiago. The
capture o,f that town, if it results from
the prosecution of the present plan of
operations by General Shafter, will re^ilound to Shafter s credit,, for General
Miles has declared explicitly that he
does not assume the. conduct of
these operations.
