The war department has given out the
following from General

“Headquarters, near Santiago, July 13,
Your tel^ram saying that no modifi­
cations of orders will be allowed is just
received. I have had an interview of
an hour and a half with General Toral
and have extended the truce until noon
tomorrow. 1 told him that his surrender
only wiH be considered, and that he
was without hope of escape and had no
right to continue the fight. 1 think I
I made a strong impression on him.
. and hope for bis surrender. If he re­
fuses I will open on him at 12, noon, to­
morrow, with every gun.
I have and will have the assistance
of the navy who arc ready to bombard
the city with i3*inch shells.

• Secretary Alger has received the fol­
lowing dispatch from General Miles:
“Playa del Este. July, 13. At a meet­
ing between the lines, at which Gener­
al Shafter and General Wheeler and
the Spanjsh General Toral were pres-ent, the latter claimed he is unable to
act without the authority of his govern­
ment, but he has received authority to
withdraw and 'surrender the harbor
ports, munitions of war. and the east­
ern portion of Cuba. He urgently re­
quests until tomorrow noon to receive
an answer from his government regard­
ing the offer of our government, to
send his forces to Spain, which was
granted. (Signed) Miles."^

On the bulletin giving General Miles’
dispatch was written underneath the
dispatch the following: “Permission to
withdraw, was declined by the war de­
partment. (Signed)
R. A. A."

gent leader, replied that the overtures
of the Spanish commander came too
late.
